1. About This Policy

GENESYS Health Alliance, LLC (“GENESYS,” “we,” “us,” or “our”) is a physician-owned correctional healthcare organization headquartered in Waycross, Georgia. We provide medical, mental health, and related healthcare services to county jails, detention centers, and correctional facilities.

This Privacy Policy explains how we collect, use, share, and protect information in connection with www.genesyshealth.net and any other website, landing page, or online form we operate that links to this policy (collectively, the “Site”).

Please read Section 2 carefully. It explains an important distinction between this policy and the separate protections that apply to patient health information.

2. Important — This Policy Does Not Cover Patient Health Information

This Privacy Policy applies only to information collected through our Site — for example, from county officials researching our services, prospective employees, vendors, and members of the public who visit our website.

This policy does not govern protected health information (PHI). Health information about individuals who receive care from GENESYS at a correctional facility is governed by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), applicable state law, and the terms of our agreements with the facilities and agencies we serve. Those protections are described in our Notice of Privacy Practices, which is made available at the facilities where we provide care and upon request.

If you are:

• An incarcerated individual, or a family member, attorney, or representative of one, and you are seeking medical records, records of care, or information about an individual’s medical treatment — do not submit that request through this Site. Requests must be directed to the correctional facility where the individual is or was housed, or to the health services administrator at that facility. We cannot verify identity or lawful authority through a website form, and we cannot confirm or deny whether any individual is or was in our care.
• A member of the public with a general question, please note that anything you submit through this Site is treated as ordinary business correspondence, not as PHI.

Do not send medical information, diagnoses, medication lists, treatment details, Social Security numbers, or inmate medical records through any form, chat, or email link on this Site. Website communications are not a secure or HIPAA-compliant channel. If you need to transmit health information to us, contact us using the information in Section 15 and we will provide a secure method.

3. Information We Collect

3.1 Information You Provide Directly

We collect information you choose to give us, including when you:

• Submit a contact form, service inquiry, or request for proposal information
• Schedule a facility assessment or request a meeting with our business development team
• Request a quote or capabilities statement
• Apply for employment or submit a résumé or credentialing information
• Subscribe to updates, newsletters, or announcements
• Visit our booth at a conference or trade show and provide contact information that is later entered into our systems
• Correspond with us by email, telephone, or mail using information listed on the Site

Depending on the interaction, this may include: your name, title or role, agency or employer, work email address, telephone number, mailing address, county or jurisdiction, professional licensure and credentialing details (for applicants), employment history, and the contents of any message you send us.

3.2 Information Collected Automatically

When you visit the Site, certain information is collected automatically by our web servers, our hosting provider, and analytics and tag management tools, including Google Tag Manager and the analytics and advertising services deployed through it:

• IP address and approximate geographic location derived from it
• Network and organization information, including your internet service provider, hosting provider, or the organization to which your IP address is registered
• Device and browser information, such as browser type and version, operating system, screen resolution, and device type
• Usage information, such as the pages you view, the date and time of your visit, how long you remain on a page, the links you click, the referring website or search engine, and the search terms that brought you to the Site
• Cookie and identifier data, as described in Section 4

3.3 Business Identification of Visiting Organizations

Because GENESYS serves government agencies, we use commercially available tools and public internet registry data (such as ARIN WHOIS records, reverse DNS lookups, and autonomous system information) to identify, where possible, the organization or geographic area associated with a visitor’s IP address — for example, to recognize that a visit originated from a particular county government network or from a specific region we serve.

We use this information for business development, market research, and to understand which jurisdictions are interested in our services. This is organization-level and location-level analysis, not individual-level identification. We do not use these tools to attempt to identify the specific person operating a device, and we do not attempt to attach a name to an IP address.

If you prefer that your visit not be associated with your organization, you may visit the Site from a personal network or use a VPN or similar privacy tool.

3.4 Information From Third Parties

We may receive information about you from:

• Conference and trade show organizers (for example, attendee or badge-scan lists from sheriffs’ association conferences and corrections industry events)
• Public records, government procurement portals, and bid notification services
• Business contact databases and professional networking platforms
• Advertising and analytics partners, as described in Section 5
• References, background screening vendors, licensing boards, and credentialing verification organizations, in connection with employment applications and consistent with applicable law

4. Cookies and Similar Technologies

The Site uses cookies, pixels, tags, local storage, and similar technologies. These fall into the following categories:

• Strictly necessary — required for the Site to function, load pages, and maintain security.
• Performance and analytics — help us understand how visitors find and use the Site, which pages perform well, and where visitors encounter problems.
• Advertising and targeting — used by us and our advertising partners to deliver and measure advertising, including retargeting visitors who have previously visited the Site.
• Social media — set by platforms such as LinkedIn and Facebook when you interact with our pages or with social content embedded on or linked from the Site. These platforms collect information under their own privacy policies, which we do not control.

Most browsers allow you to refuse or delete cookies through their settings. Disabling cookies may cause parts of the Site to function improperly. Instructions are available in your browser’s help documentation.

Do Not Track and Global Privacy Control. Browsers may transmit “Do Not Track” or Global Privacy Control signals. There is currently no uniform industry or legal standard governing how these signals must be honored, and the Site does not currently respond to them. [Legal review note: revise this paragraph if you elect to honor GPC, or if a state law applicable to GENESYS later requires it.]

5. Advertising

We advertise our services to correctional and county government decision-makers. Our advertising may include:

• Display and search advertising on third-party websites and search engines
• Retargeting, which shows GENESYS advertisements to people who have previously visited the Site
• Location-based and geofenced advertising, which delivers advertisements to devices that have been present within a defined geographic area — for example, a convention center hosting a sheriffs’ association conference. This advertising is delivered by third-party ad platforms using device location and mobile advertising identifiers that those platforms collect from mobile applications. GENESYS receives aggregated campaign performance reporting from these platforms; we do not receive the names of individuals who were served an advertisement.

You can generally limit interest-based and location-based advertising through your device settings (for example, “Limit Ad Tracking” on iOS or “Delete advertising ID” on Android) and through industry opt-out tools such as the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org).

6. How We Use Information

We use the information described above to:

• Respond to inquiries, requests for information, and requests for proposals
• Provide information about our services to counties, sheriffs’ offices, jail administrators, and other prospective clients
• Evaluate employment applications and conduct credentialing and licensure verification
• Operate, maintain, secure, troubleshoot, and improve the Site
• Analyze Site traffic, measure interest by jurisdiction, and conduct market and competitive research
• Plan, deliver, and measure advertising and conference marketing
• Send business communications, updates, and announcements you have requested
• Comply with legal, regulatory, contractual, accreditation, and public-procurement obligations
• Detect, investigate, and prevent fraud, abuse, security incidents, and other unlawful activity
• Establish, exercise, or defend legal claims

7. How We Share Information

We share information only as described below.

• Service providers. We use third parties to host our website, deliver email, manage customer relationships, provide analytics and tag management (including Google), deliver advertising, receive and process employment applications (ADP WorkforceNow), and provide IT and security services. These providers may access information only to perform services for us and are contractually restricted from using it for their own purposes.
• Client agencies. Where relevant to a contract, procurement process, or facility operation, we may share business contact information with a county, sheriff’s office, or other agency.
• Professional advisors. Attorneys, accountants, auditors, and insurers, subject to confidentiality obligations.
• Legal and safety. We may disclose information when required by law, subpoena, court order, or government or regulatory request; to comply with open records or public procurement requirements applicable to our government clients; or where we reasonably believe disclosure is necessary to protect the rights, property, or safety of GENESYS, our clients, our personnel, or the public.
• Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction.

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising in exchange for monetary consideration. [Legal review note: confirm this statement remains accurate against every ad platform and data-sharing arrangement GENESYS actually uses before publishing. Some state laws define “sale” broadly enough to capture certain ad tech arrangements even where no money changes hands.]

8. Employment Applicants

Applications are submitted through a third-party system. Our “Apply” and “Explore Careers” links take you to ADP WorkforceNow, an applicant tracking platform operated by ADP, Inc. Information you enter there is collected by ADP on our behalf and is also subject to ADP’s own privacy practices. Our employee portal is likewise hosted by a third-party provider.

If you apply for a position with GENESYS, we collect and process the information you submit and information obtained during the hiring process. This may include your résumé, employment and education history, professional licenses and certifications, references, and — where permitted by law and with any required authorization — the results of background checks, drug screening, and credentialing verification. Because our personnel work inside secure correctional facilities, employment is generally conditioned on clearance requirements imposed by the facilities and agencies we serve, and relevant information may be shared with those agencies for clearance purposes.

We retain applicant information for the period required by applicable federal and state recordkeeping rules and for consideration for future openings, unless you ask us to remove it.

9. Data Security

We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, and destruction. These include access controls, encryption in transit for Site traffic, vendor security review, and workforce training.

No method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee absolute security, and any transmission of information to us through the Site is at your own risk. See Section 2 regarding health information.

10. Data Retention

We retain information for as long as necessary to fulfill the purposes described in this policy, and thereafter as required to comply with legal, contractual, accreditation, tax, and recordkeeping obligations, to resolve disputes, and to enforce our agreements. Retention periods vary by record type and by the requirements of the jurisdictions and agencies we serve. When information is no longer needed, we delete it or de-identify it.

11. Your Choices and Rights

Regardless of where you live, you may:

• Opt out of marketing email by using the unsubscribe link in any marketing message or by contacting us. We may still send transactional or relationship communications, such as responses to your inquiry.
• Request access, correction, or deletion of the personal information we hold about you.
• Ask a question about our privacy practices at any time.

Several states have enacted comprehensive consumer privacy laws that grant residents rights to access, correct, delete, and obtain a portable copy of their personal data, and to opt out of targeted advertising, sale of personal data, and certain profiling. These laws generally apply only to businesses meeting specified size or data-volume thresholds, and they generally exclude individuals acting in a commercial or employment context — which covers most interactions with this Site.

Where such a law applies to us and to you, we will honor the rights it provides, including the right to appeal a denial of a request. Where it does not, we will still consider requests submitted under Section 15 in good faith.

To submit a request, contact us using the information in Section 15 with the subject line “Privacy Request.” We will need enough information to verify your identity before acting on a request. We will not discriminate against you for exercising these rights.

12. Children’s Privacy

The Site is directed to government agencies, correctional professionals, and job seekers. It is not directed to children, and we do not knowingly collect personal information from children through the Site. If you believe a child has provided information through the Site, contact us and we will delete it.

This section concerns website visitors only. Healthcare services provided to minors in juvenile detention or other correctional settings are governed by HIPAA, applicable state law, and our agreements with the responsible agency — not by this policy.

13. Third-Party Websites and Links

The Site may link to third-party websites, including county and sheriff’s office sites, professional associations, procurement portals, and job boards. We do not control those sites and are not responsible for their content or privacy practices. Review the privacy policy of any site you visit.

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above and post the revised policy on this page. Material changes will be identified in a notice on the Site. Your continued use of the Site after an update constitutes acceptance of the revised policy.
